Judicial review seeking relief from Patent Office decision refusing request to reinstate abandoned patent application—Patent examiner issuing requisitions pursuant to Patent Rules, SOR/96-423, rr. 29, 30(2)—As applicants not replying, notices of abandonment issued by Patent Office—Issues whether r. 29 ultra vires Patent Act, R.S.C., 1985, c. P-4, s. 73(1)(a), application deemed abandoned by operation of law or discretionary decision by Commissioner—R. 30(3), s. 73(1)(a) spelling out “good faith” notion, contrary to r. 29—However, r. 29 focussing on examiner’s requisition for further information, no room at this stage for good faith—Good faith coming into play only when assessing applicant’s reply, if reply sent—Hence, r. 29 consistent with s. 73(1)(a)—Consequences of not replying mandatory in nature—Neither Commissioner, Federal Court having jurisdiction to modify, set aside, ignore consequences—No discretion, judgment on part of Commissioner required—Application dismissed.
