Motion for orders allowing for written examination for discovery of Internet service providers to identify, disclose to plaintiff names, addresses connected to customer accounts associated with certain IP addresses—Defendants copying, distributing film over Internet without authorization of copyright owner, i.e. plaintiff—Defendants identifiable only by IP addresses—Without information relating to IP addresses, plaintiff unable to identify those infringing its copyright—Personal Information Protection and Electronic Documents Act, S.C. 2000, c. 5, s. 7(3) allowing for disclosure of personal information on court order—Principles established in BMG Canada Inc. v. John Doe, 2005 FCA 193, [2005] 4 F.C.R. 81 applying to case at bar—Plaintiff having bona fide claim against defendants, meeting criteria of Federal Courts Rules (SOR/98-106), r. 238, namely, information requested relevant, action against defendants unable to be brought without their names, addresses—Motion granted.
